E-discovery, re-imagined
Falcon Discovery is transforming the way corporate legal departments manage discovery in the digital age. It started in 2004 when Qwest Communications asked Falcon’s founder, Don McLaughlin, to survey the escalating cost and complexity of the legal discovery process.
Given an opportunity to re-imagine the discovery process from the ground up, Don enlisted a team of lawyers and technologists to create a new framework for aligning people, processes and technologies to optimize the discovery process. Working as an extension of the legal department, Falcon’s team engineered a whole new approach to managing legal discovery - from the inside out.
The result is InsideOut™, Falcon’s innovative in-house e-discovery service managed by Falcon’s team of lawyers and technology specialists. By 2008, Falcon had grown to help other Fortune 500 companies enhance their discovery technologies and processes. That same year Corporate Counsel magazine selected Qwest’s legal department as Legal Department of the Year, specifically citing its innovative relationship with Falcon Discovery (see article).
Today, Falcon maintains its exclusive focus on helping clients leverage in-house process innovation and advanced technology to manage legal discovery more quickly, efficiently and cost effectively.

Senior Leadership
Falcon Discovery’s executive leadership helps clients optimize the e-discovery process by applying a range of expertise, including forensics, records retention, technology and process consulting, litigation and discovery management, and production management. Our executive team coordinates and oversees our staff attorneys and technology specialists in their work managing cases through the lifecycle of discovery, from preservation, collection, and early case analysis through searching, review, and production.

Don McLaughlin, Jr., Esq.
Don McLaughlin is a founding partner, board member, and president.Don works directly with Falcon’s clients to help them optimize their legal discovery processes. As chief architect of Falcon’s InsideOut™ model, his thought leadership is often cited in legal publications and he is a featured speaker at legal and business conferences.
Prior to founding Falcon, Don’s consulting practice helped Qwest Communications manage the legal and technical challenges associated with electronically stored information (ESI) on high-stakes criminal and civil litigation matters.
In the past, he practiced commercial litigation at Sherman & Howard, one of the Mountain West’s largest regional firms. He also served as a deputy district attorney in Colorado’s Eighth Judicial District.
A recognized thought leader on in-house e-discovery, in 2007, Don served as an editorial adviser for the publication, “Navigating the Hazards of E-Discovery: A Manual for Judges in State Courts Across the Nation,” which was published by the Institute for the Advancement of the American Legal System at the University of Denver.
Don earned his J.D. from the University of Denver and graduated magna cum laude with a Bachelor of Arts from the University of Vermont, and studied internationally at the University of London and the Université de Grenoble.

Cody Greenwaldt, Esq.
Cody collaborates with in-house and outside counsel and oversees the provisioning of eDiscovery services, including in-house e-discovery response, preservation, collections and forensics, processing and culling, searching and early case assessment, document review and production management.Prior to joining Falcon Discovery, Cody worked as in-house counsel for a Fortune 200 company and he was responsible for the ongoing development and implementation of the company’s corporate ethics and compliance program and conducted internal investigations, which required extensive interviewing and electronic data analysis.
Cody has also worked as a managing attorney providing large-scale document analysis, review and related services in response to high-profile document requests and government investigations.
Cody received his J.D. from the University of South Dakota School of Law and his B.S. from the South Dakota School of Mines and Technology.

John Mooney, Esq.
John Mooney is Director of Client ServicesJohn is responsible for effective delivery of discovery solutions to our clients. As a client liaison to Falcon’s legal and technology consultants, he ensures each team continually meets and exceeds the expectations of our clients.
Prior to joining Falcon, John managed the discovery and document review process at a Fortune 500 company. John was also a judicial intern in the Southern District of New York.
He received a J.D. from Touro College in Central Islip, New York.

Matthew Porter, Esq.
Matthew Porter is Director of Legal TechnologyMatt oversees Falcon’s technology solutions. In this role, he maintains a deep understanding of e-discovery technologies, including emerging tools, hardware, and applications.
Before joining Falcon, Matt was Senior Client Manager at Xerox Litigation Services, where he provided case management and electronic discovery services to top law firms and Fortune 500 companies.
Prior to his time at Xerox, he practiced law at McKenna & Cuneo (Washington D.C.), Faegre & Benson (Denver) and at his own litigation consulting practice.
Matt is often a featured speaker on e-discovery issues and has published articles about legal issues affecting software development.
Matt holds a law degree from New York University and a Bachelor’s degree in Computer Science and in English from Hofstra University.

Martin Siefert
Martin Siefert is Director of Electronic Data Discovery (EDD) and Digital ForensicsMartin has an extensive background in digital forensics and network security, as well as software and web application development.
Before joining Falcon, Martin worked for Experian where he managed the company’s worldwide EDD projects, including digital forensic investigations for their cyber incident response team.
Martin holds a Bachelor’s degree in Computer Science. His professional certifications and affiliations include:
- Certified Computer Examiner (CCE) through the International Society of Forensic Computer Examiners (ISFCE)
- EnCase Certified Examiner (EnCE) through Guidance Software
- EnCase Certified eDiscovery Practitioner (EnCEP) through Guidance Software
- Active member of the High Technology Cyber Crime Investigation Association (HTCIA)
- Active member of the Colorado Association of Computer Crime Investigators (CACCI)
He also volunteers his expertise in digital forensics to the digital crime lab at the Lakewood Police Department in Lakewood, Colorado.
